Français General Terms and Conditions of Sale (GTCS)
Article 1 - Purpose
These general terms and conditions of sale (GTCS) govern the contractual relationship between the boat tour agency in Martinique (hereinafter referred to as “the Agency”) and any person (hereinafter referred to as “the Customer”) making a reservation for a boat tour.
Article 2 - Reservation and Payment
1- Reservation: Any reservation made with the Agency can be confirmed by paying a deposit of 50% of the total price of the tour or by paying the full price.
2- Deposit: The payment of the 50% deposit guarantees the reservation. The remaining balance must be paid in full before the boat’s departure.
3- Full Payment: The Customer also has the option to pay the full price at the time of booking.
Article 3 - Payment Terms
1- Accepted Payment Methods: Payments can be made by credit card, bank transfer, or any other payment method accepted by the Agency.
2- Payment Before Departure: The total payment for the reservation must be made before the boat’s departure. In the absence of full payment, the Agency reserves the right to deny boarding.
Article 4 - Cancellation and Refund
1- Non-refundable Deposit: The 50% deposit is non-refundable, except in the case of cancellation by the Agency.
2- Cancellation by the Customer: In the event of cancellation by the Customer, the 50% deposit will be retained by the Agency. If the Customer has paid the full price, the amount remaining after deducting the deposit will be refunded to the Customer.
3- Cancellation by the Agency: In the event of cancellation by the Agency, the Customer will be fully refunded the amounts paid, including the deposit.
Article 5 - Liability
1- Safety and Onboard Rules: The Customer agrees to comply with the safety instructions and onboard rules communicated by the crew.
2- Weather Conditions: The Agency cannot be held responsible for tour modifications or cancellations due to unfavorable weather conditions. In such cases, an alternative solution will be offered to the Customer.
Article 6 - Intellectual Property
All elements of the Agency’s website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of the Agency.
Article 7 - Personal Data
The information collected about the Customer is subject to processing intended for managing reservations and improving the Agency’s services. In accordance with the “Data Protection Act,” the Customer has the right to access and rectify personal data concerning them.
Article 8 - Applicable Law and Jurisdiction
These GTCS are subject to French law. In the event of a dispute, and failing an amicable solution, the French courts will have sole jurisdiction.
Article 9 - Acceptance of the GTCS
By confirming their reservation, the Customer declares to accept without reservation the terms of these General Terms and Conditions of Sale.
